Helping You Achieve The Goals You Envision For Your Family

How to Win Your Child Custody Case

Bivek Brubaker & Prescott LLC | Jul 20, 2018 | Child Custody, Divorce

It’s hard not to get emotional when it comes to your kids. You want what’s best for them, and you might have strong ideas about what that means. But if you’re involved in a Marietta child custody case, you’ll have to push the stress aside as you navigate court appearances, possible custody evaluations, and negotiations with your ex-partner.

How to win a custody battle

During this time, it’s important you project the best version of yourself not only in front of the judge but outside the court, as well. Whether you’re in the middle of a divorce or you’re unmarried and seeking custody and visitation, compromise and cooperation are likely to do the most good during this challenging time. As Marietta child custody attorneys, we’ve represented hundreds of parents. The following tips are some of the best strategies we know for winning a case.

Show you’re willing to work with your ex-partner

Immediately after a divorce, your anger and hurt may feel overwhelming. In some situations, they may even blind you to your greater goal—preserving the relationship you want with your children—and lead you to shut down any talks with your former partner. But it’s crucial to keep talking. Your ex is a part of your children’s lives, and by showing the judge you’re willing to work together for the good of your kids, you’re more likely to come away with a parenting plan that works for everyone. (It’s worth noting this only goes for non-abusive partners. If you’re ending a violent relationship and seeking full custody, your first priority is your family’s safety.)

Keep your frustrations away from your kids

As frustrated as you may be with your ex-partner, don’t let that anger spill out in front of your kids. Instead, keep it cordial and avoid burdening your children with the extra stress of hearing negative comments about a parent. Ideally, both you and your ex-partner will take a similarly high-minded view—no matter how strained your relationship. If, on the other hand, your former partner airs everything in front of the kids, make a note of it, but move on. It will likely only help your Marietta child custody case.

Use your visitation rights

If you have visitation rights and are seeking custody, the judge will want to see how involved you already are. Full- or partial-custody parenting is of course not all kindergarten graduations, birthday parties, and soccer finals. Show you’re involved in the day-to-day—the doctor’s appointments, the school drop-offs, and the chores. Make sure you’re always on time for visits and try to reschedule as little as possible.

Work with a child custody lawyer

So much of a child custody case is perception—the judge will be looking at every piece of available information to decide what parenting arrangement is likely to work best for the child or children. That’s why you need a custody attorney to ensure your documentation is in order, guide you toward presenting your best self in court, and articulate your story. Experienced Marietta child custody attorneys can help shape your case, advocating for the fair custody you deserve.

At Bivek Brubaker & Prescott, we provide each of our clients with steady guidance and compassion as we work toward an arrangement that’s best for you and your kids. As child custody and child support lawyers in Marietta, GA, we can help. Contact us for a free consultation or call 470-663-9404.
